Collect deposit and rent

Remember that if you collect rent weekly you must use a rent book - it is more straightforward to collect rent by the calendar month. The deposit can be a maximum of 2 times the monthly rent.

Sign prior documents

It is essential to issue certain notices and get agreement on various things before the lease agreement is signed -

  • AT5 - this must be issued to each tenant
  • Prior Notification of Grounds - your mortgage provider will insist this notice is issued
  • Repairing Standard Letter - under the Housing (Scotland) Act 2006, this letter must be given to each tenant to let them know their rights
  • Key Agreement - the tenant is the occupier and they can insist you don't hold keys to the property - the best solution is to get a key agreement signed prior to signing the lease

Sign tenancy agreement

You must ensure this is signed after the prior documents listed above. The signatures must be witnessed by a person who is over 18, knows the tenant(s), and is not a co-signatory.
