The lettings market in Scotland is currently unregulated, meaning that anyone can set up a lettings agency and are free to operate as they wish, without adhering to any specific guidelines or code of conduct.

This will change following the Scottish Governments’ implementation of mandatory registration and regulation for letting agents under the Housing (Scotland) Act 2014, however, this will not be a reality until 2018 at the earliest. In the meantime, letting agents can opt to join regulatory bodies but unfortunately, few have chosen to do so. 

At Clan Gordon we understand that clients trust us with their most important assets, and so we are members of the Royal Institution of Chartered Surveyors (RICS), the Association of Residential Letting Agents (ARLA) and also registered with the SafeAgent Scheme.

When asked in our 2016 Landlord Satisfaction Survey, 97% of our landlords confirmed that it is important to them to use a regulated agent. 

We are proud to be one of the few letting agents in Edinburgh to be a firm of Chartered Surveyors, allowing us to be regulated by RICS. In addition to this we have also chosen to join ARLA, adding an extra level of professionalism and protection for our clients. Being regulated by both RICS and ARLA means that we follow a strict code of conduct and are audited annually. Our clients can expect:

We act with integrity at all times, avoiding conflicts of interest, and upholding professional standards. Landlords using a regulated agent can be sure that they are dealing with a professional and competent agent, as can tenants and contractors.

Regulated agents must always adhere to the highest levels of professionalism in the service that they provide.

Training and Continuing Professional Development

As a regulated agent we must keep up to date with changes to industry legislation. All of our staff undergo continuous training, passing this information on to clients as required, and taking steps to ensure that all of our landlords and properties are compliant.

Complaints Handling

We have a clear complaints handling procedure in place, allowing all clients access to a fair and straightforward system through which to have complaints dealt with.

Client Money Protection

All client funds are held in a designated client account and are protected through the SafeAgent client money protection scheme.

Professional Indemnity Insurance

All of our work – both previous and current – is covered by professional indemnity insurance. This means that if we make a mistake our client would not lose out financially.
